Terms and Conditions for Cosmosis
Effective Date: February 23, 2025

1. Introduction

Welcome to Cosmosis. By embarking on any of our audio Quests, you accept these Terms and Conditions. These Quests involve audio-guided experiences that users undertake at their own risk. By using the Cosmosis Quests app, you acknowledge and agree to the terms outlined below.

2. Assumption of Risk & Liability Disclaimer

  • You acknowledge that participation in any Quest is entirely voluntary and undertaken at your own risk.
  • We (Cosmosis and any associated entities) are not responsible for any injuries, accidents, property damage, or other incidents that occur while participating in a Quest.
  • Users must ensure their own safety by being aware of their surroundings, following all applicable laws, and exercising caution while engaging with the Quests.
  • By using the app, you waive any claims against us related to injuries, damages, or losses incurred during participation.

3. Ownership & Copyright of Audio Content

  • All Quest audio content provided through this app remains the sole intellectual property of Cosmosis.
  • Users are not permitted to copy, distribute, modify, or use the audio content for any purpose other than personal engagement with the Quest.
  • Any unauthorized reproduction or distribution of the audio content may result in legal action.

4. Audio Sharing & Data Handling

Some Quests may invite users to record and share their own audio. Each Quest has its own consent options, detailed below:

Stories of Soil & Stone

Your phone will record the message you tell the stone and the soil. This will be stored locally on your phone. You have the option to share your recordings in one of three ways:

  1. Upload
    • Your voice recording will be uploaded as-is.
    • You grant Cosmosis full rights to use it in its raw form, including in potential future quests, installations, or projects.
  2. Upload Anonymously
    • Your recording will be uploaded, but your voice will not be used.
    • If your words are used in a project, they will be re-recorded by another person.
    • You remain anonymous while granting full rights to the content of your recording.
  3. Delete Recording
    • Your recording will be permanently deleted and will not be uploaded or shared.

The Night Within & Without

At some point in this Quest, you’ll be made aware that the phone records an audiomessage, which will be stored locally on your phone. You have the option to share your recording in one of three ways:

  1. Consent
    • Your recording will be uploaded as-is.
    • You grant Cosmosis full rights to use it in its raw form for this project.
  2. Consent & Broader Use
    • Your recording will be uploaded as-is.
    • You grant Cosmosis full rights to use it for this project and any future projects, quests, installations, or creative works.
  3. Do Not Consent
    • Your recording will be deleted from your device and will not be uploaded or shared.

5. Quest Unlocking & Access

  • Some Quests require a password to unlock.
  • Unlocking a Quest does not guarantee indefinite access; access is stored locally on your device and can be lost if the app is deleted or reinstalled.
  • We do not store Quest unlocks on external servers, and we are not responsible for lost access due to device changes or app reinstallation.

6. Availability & Service Changes

  • We may modify, suspend, or discontinue parts of the service at any time without prior notice.
  • Temporary unavailability may occur due to maintenance, updates, or other factors beyond our control.
  • We are not responsible for any consequences resulting from service interruptions.

7. User Responsibilities

  • Users must ensure their devices are functional and adequately charged while using the app.
  • Users must be in a safe environment when engaging with the Quest and should not participate in activities that put them at risk.

8. Data Loss Disclaimer

  • All Quest progress, including unlocks and recordings, is stored locally on your device.
  • If the app is deleted, updated, or reinstalled, this data may be lost, and we are not responsible for recovering it.

9. Prohibited Use & User Conduct

  • Users may not attempt to extract, modify, or distribute audio files from the app.
  • Users must not interfere with the functionality of the app or engage in activities that harm others’ experience.
  • Any misuse of the app may result in suspension of access.

10. Liability for Third-Party Links or Content

  • The app may contain links to external content for informational purposes.
  • We are not responsible for third-party websites, services, or their content.
  • Accessing third-party links is at the user’s own risk.

11. No Emergency Use Disclaimer

  • Cosmosis is not an emergency service and should not be relied upon for urgent assistance.
  • Users experiencing a crisis should seek immediate help from local emergency services.

12. Rights and Compensation

  • By uploading your recording, you transfer full rights to Cosmosis to use, modify, distribute, and incorporate it into other media.
  • You acknowledge that there is no obligation to use your recording.
  • You will not receive any compensation, royalties, or other benefits from the use of your uploaded recordings.

13. Request for Removal

  • If you wish to revoke your consent after uploading, you may request removal by contacting paul@cosmosis.quest.
  • Upon request, we will permanently delete your recording within 14 days and cease its future use.

14. Privacy & Data Protection (GDPR Compliance)

  • No personally identifiable information (such as your name) is collected unless you explicitly provide it.
  • If you choose an anonymous upload, your voice will not be attached to the recording.
  • Your recordings are stored locally on your device until uploaded. If you select “Do Not Consent” or “Delete Recording,” the recordings will be permanently erased from your device.

15. Governing Law & Jurisdiction

  • These Terms and Conditions are governed by the laws of the Netherlands.
  • Any disputes arising from these Terms shall be resolved in the competent courts of the Netherlands.
  • Users outside the Netherlands are responsible for ensuring compliance with their local laws.

By using this app and participating in its Quests, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree, do not proceed with any Quest or upload any recordings.
